In the midst of the legal battle between the US government and state of Texas over the controversial anti-migrant buoy border between Texas and Mexico, the United States Department of Justice has filed a lawsuit, aiming to challenge the legality of this barrier.

The Biden Administration has revealed its plans to file a lawsuit against the state of Texas, due to concerns about the environmental and humanitarian effects of the border. The Justice Department officially issued a letter to Texas authorities, asserting that the border set up by the state is violating federal law and is causing concerns about humanitarian issues, public safety, and environmental threats.

US Attorneys Todd Kim and Jaime Esparza have stated that this unauthorized border violates the Rivers and Harbors Act, which explicitly “forbids any creation of obstructions impacting the navigational capabilities of United States waters.”

Meanwhile, Governor Abbot has been vocal in defending Texas’ actions, asserting that the state holds the sovereign authority to safeguard its border under both the US Constitution and the Texas Constitution. He maintains that he has communicated with the Department of Justice, sending several letters regarding the authorization of the border, with no reply.

However, Aaron Reichlin-Melnick, Policy Director of the American Immigration Council, countered Abbot’s claims, stating that “the Constitution does not contain any provision that supports such arguments. This might explain the Biden administration’s lack of response to the aforementioned claims.”

The attorneys, Kim and Esparza, have set a deadline of July 24th for Texas to dismantle the line of bright orange buoys stretching across the Rio Grande River for around 1,000 feet. And failure to adhere to this deadline will result in filing a lawsuit against the state of Texas.

Governor Abbott has shown resistance in complying with the federal government’s instructions. Even though the deadline looms, Abbott has yet to comply and instead wrote a direct letter to the Biden administration, urging them to take decisive action in enforcing federal immigration laws to avoid illegal border crossings.

Abbott’s refusal to remove the border barrier has prompted the US government to initiate a legal proceeding against the state of Texas.

Governor Abbott has issued a response to the lawsuit, stating that Texas intends to argue it’s constitutional rights and even issued a stern warning that the state stands prepared to escalate the matter to the courts if required.

“Texas is fully committed to exercising its constitutional authority in managing the crisis caused by your actions,” Governor Abbott conveyed in a letter addressed to the Biden administration.

“We’ll meet you in court, Mr. President.”
