In April of this year, Biden signed a bill that called for the sale of TikTok, which is owned by a Chinese company, to a non-Chinese company.This is because politicians believe that there is too much of a risk of TikTok users’ data going to the Chinese government.
ByteDance, the company that owns TikTok, took this case to an American court, claiming that the ban would impede on the 1st amendment rights of the Americans who use the app. This is because TikTok is a popular app on which many Americans express their opinions, advertise their products, etc. TikTok, in response to the bill, has stated that the bill would “trample the free speech rights of 170 million Americans, devastate seven million businesses, and shutter a platform that contributes $24 billion to the US economy, annually.”
However, TikTok’s case was rejected, causing TikTok to take this case to the Supreme Court. The Supreme court will make the final decision on whether or not the ban will take place. However, it’s still looking bad for TikTok, because congressmen overwhelmingly support a bipartisan law that will force ByteDance to sell TikTok to a non-Chinese company, or be banned from the US by January 19th, 2025.
Donald Trump, who is going to be inaugurated on January 20th, has stated that he doesn’t support the ban of the app. Trump, the president-elect, has previously threatened to force TikTok to be banned, but now opposes the ban of the app.
Trump has requested the Supreme Court to push the law’s January 19th effective date back, so his new administration could “pursue a negotiated resolution that could prevent a nationwide shutdown of TikTok, thus preserving the First Amendment rights of tens of millions of Americans, while also addressing the government’s national security concerns.”
However, due to the fact he’s set to be inaugurated the day after TikTok is set to be banned, few think he has the power to stop the ban.
